Licensing

Obtaining an aged care licence (home care and/or residential care), or NDIS provider licence is the essential first step for providers entering the sector or expanding operations. But the process is highly regulated, often confusing, and subject to shifting requirements under the Support at Home reforms (commencing November 2025).

    • Conducting due diligence on the licence, including compliance history, regulatory standing, and outstanding risks.

    • Providing valuation support, benchmarking against market trends and recent transactions.

    • Drafting and negotiating sale contracts, shareholder agreements, and warranties to protect your interests.

    • Guiding you through ACQSC notifications and regulatory approvals for change of control.

    • Managing completion obligations, including employee transfers, lease arrangements, and client communications.

  • Brokerage Agreements: Preparing and reviewing aged care brokerage agreements, where an Approved Provider engages external organisations or contractors to deliver services on its behalf to make sure the agreements clearly allocate responsibilities, safeguard compliance with ACQSC standards, and protect the provider from legal and financial risk.

  • Transitional Arrangements: Advising providers on their rights and obligations under the new Aged Care Act 2024 and Support at Home reforms. From 1 November 2025, existing approved providers will automatically transition into the new system and retain registration. We guide providers in updating compliance systems, adapting care models, and preparing for the further integration of CHSP into Support at Home from 1 July 2027.

  • Risk Management: Identifying risks that may cause refusal or revocation and providing strategies to address them.
